FILING OF POSH ANNUAL REPORT - 2024 (UNDER POSH ACT, 2013)
BACKGROUND: Every organization is required to submit a POSH “Annual Report” for previous calendar year in January.
This is as per Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 and Rules (“Law”). As per Law, the Internal Committee (IC) has to submit the Annual Report to the Employer. Employer forwards it to authorities.
The Due Date For Filing The Report Is 31st January 2025*
*The last date for filing in Gurgram District is 28th February 2025*
The procedure is straightforward and 9 simple steps are involved.

STEP 1
DOWNLOAD DRAFT OF THE ANNUAL REPORT FROM THE EMAIL
Note: We have attached two drafts for your reference in the email shared :
1. As per our practical experience
2. Strictly as per law.
You may chose to use either of the drafts.
Organisations with offices in Gurgaon have different draft . The last date for submission of annual report in Gurgaon district is 28 th February 2025.
The draft has been attached in the email shared .
Organisations with offices in the Mumbai City District are required to submit a certification along with the annual report exclusively to the Women and Child Development office. This includes providing one hard copy and sending one electronic copy to the designated email addresses: dwcdmcity@yahoo.com and wdcdposh.2024@gmail.com. The submission must certify the constitution of an Internal Committee, inform that employees have been made aware of its existence, and confirm that anti-sexual harassment posters, detailing penal consequences, are displayed in the office premises. This is in pursuance of this notification. The format for such certification can be found below.
STEP 2
GATHER DATA
Once you download the template, you will see blanks where data is needed. The data required is related to no. of complaints received, disposed off, pending and action taken. It is also related to Trainings conducted. Kindly gather relevant data.
Please note:
Annual reports need to be filed separately for every separate legal entity (if such entity has 10 or more employees).
It needs to be filed separately for every branch / location / administrative unit in that 1 legal entity as well (if such branch / location etc. has 10 or more employees).
You may come across one or more of the following instances:
If you have multiple offices across the country with 10 or more employees in each office, you need to file the annual report for each office. E.g: If you have offices in Mumbai, New Delhi & Hyderabad with 10 or more employees in each office, you need to file 3 annual reports.
If you have multiple offices across the country but 10 or more employees only in some offices, you need to file an Annual Report only for those offices having 10 or more employees. E.g.: If you have offices in Mumbai, New Delhi, & Hyderabad and Mumbai has 30 employees but New Delhi and Hyderabad have 5 and 8 employees, you need to file 1 annual report only.
If you have multiple sister concerns with 10 or more employees, you need to file separate Annual Reports for each entity even if they operate from the same office. E.g.: ABC Private Limited and XYZ LLP are sister concerns and work out of the same premises. ABC and XYZ will have to file separate Annual Reports.
Based on your structure and number of locations, you will need to gather the data accordingly.
Please note, if you have a Gender Neutral Policy:
Data is needed only for those complaints where the Aggrieved Person was a woman.
Complaints where the Aggrieved Person is not a Woman cannot be included in the Annual Report.
STEP 3
FILL DETAILS IN THE DOWNLOADED DRAFT
Once data is gathered, kindly fill it in the downloaded template location wise and entity wise (separate drafts for each).
Please note that this Annual Report needs to be addressed to the management.
STEP 4
APPROVAL FROM IC MEMBERS AND SIGNATURE
After the data has been filled, the draft needs to be approved by IC members.
Email with Annual Report can be sent to all IC members. They can acknowledge draft on email. Then, Presiding Officer can sign the Annual Report on behalf of all IC members. In this case, only Presiding Officer signs Report.
The IC members then forward the final signed report to the management. Management then forwards it to the authorities. Please see Step 6 for more details.
STEP 5
SEND THE SIGNED REPORT TO MANAGEMENT
Once the Annual Report is signed, IC sends 3 copies to the management (or to HR, Legal, Compliance or any other team designated by management through a board resolution / order in writing to ensure compliance with POSH Law).
1 COPY is meant for internal records and 2 COPIES need to be sent to the Authorities (one copy each to the two relevant authorities) .
STEP 6
DOWNLOAD THE COVER LETTER AND INSERT ADDRESS OF AUTHORITIES
Once the management (or HR, Legal etc. as discussed in Step 5 above) receives 3 copies of the Annual Report, they need to send it to the Authorities with the Cover Letter.
Fill out the details in Cover Letter template provided in the email shared.
The Annual Report needs to be addressed to the District Officer (DO) and Women and Child Development Office (WCD) of that DISCTRICT in which DISTRCIT you have your registered / branch office. Please locate all relevant districts where you have offices and create those many Cover Letters with each address separately for all Annual Reports to be filed.
STEP 7
GET MANAGEMENT’S SIGNATURE ON THE COVER LETTER
Once the Cover Letter is finalized, the Management (or HR, Legal etc. as discussed in Step 5) has to put their signature on the Cover Letter.

STEP 8
SEND ANNUAL REPORT TO AUTHORITIES
Once Annual Report and Cover Letter, are final, physical copies need to be couriered to respective addresses of DO & WCD.
Please note that physical copies of the Annual Reports are mandatory.
You can send the physical documents through Registered AD or private couriers. Keep receipt for records.
Email IDs of some authorities are also available on the link above. You can email a scanned copy of the Annual Report in addition to the physical copies.
STEP 9
ARCHIVE
Once the Annual Reports are sent out, the copy of the Annual Report, Cover Letter, Courier Receipts and Delivery Confirmation need to be archived and stored in such a manner that it’s easily accessible in the future.
