On November 20th, we observe Trans Day of Remembrance to honor trans lives lost to transphobic violence. Transphobia, fueled by misinformation and harmful stereotypes, threatens the safety of trans individuals, exposing them to various forms of violence. Despite the 2019 Trans Act in India, discrimination and violence persist, highlighting the need for safer, more inclusive communities.

Our survey analyzed complaints handled in 2022-2023, revealing that 90% of sexual harassment complaints came from the services industry. The study highlights redressal options and outcomes.

International Men’s Day 2024 focuses on promoting positive male role models, addressing men’s health issues, and encouraging gender equality. The day highlights the importance of mental health, emotional well-being, and the positive contributions of men to society.

I - LEGAL UPDATES

The Madhya Pradesh HC ruled that an Internal Committee (IC) can attempt to resolve cases under the POSH Act via settlement before formal inquiry. The court quashed the dismissal of a professor, citing violations of POSH Act provisions, procedural lapses, and failure to follow natural justice during the inquiry.

The Madras High Court quashed a sexual harassment case, stating that hugging and kissing between two individuals in a consensual teenage love affair cannot be considered an offense under Section 354A IPC. The court found the actions were mutual and not unwelcome, thus dismissing the FIR and criminal proceedings.

The Supreme Court has directed all High Courts to ensure that victims, either physically or virtually, are present to confirm the authenticity of any settlement before quashing criminal cases, especially in serious offenses such as crimes against women. This ensures a fair review of the settlement’s validity.

II - Exploring Intersections

At Mental Health At Work, we are taking the initiative to highlight the barriers men face regarding mental health. Social expectations often prevent them from seeking support, leading to mental health issues such as stress, anxiety, and substance abuse. Despite this, many men prefer self-reliance over external support. Gender stereotypes and lack of time further complicate access to mental health resources. This initiative encourages open conversations to break these barriers and support men’s mental well-being.

Issues like stigma, bullying, homelessness, lack of support systems, and gender-neutral facilities often lead to dropout rates.
