I - LEGAL UPDATES

The Meghalaya High Court held that bail can be denied to a POCSO convict claiming juvenility if release at that stage would defeat the “ends of justice” under the JJ Act. The Court clarified that while bail is the norm for juveniles, serious circumstances and risk to justice can justify refusal even while age determination is pending.

The Delhi High Court directed that in POCSO trials, a child’s testimony should be recorded at the earliest possible stage, even before arguments or evidence from the accused, to protect the child from prolonged trauma. The court emphasized that this approach aligns with the child-friendly spirit of the POCSO Act and safeguards young witnesses.

Did you know that recently, a child with cerebral palsy was unfortunately prevented from entering a public park in New Delhi, India? This incident highlights a significant challenge: despite clear laws like the Rights of Persons with Disabilities (RPWD) Act that explicitly prohibit discrimination against persons with disabilities, including children, a lack of awareness and persistent stigma remain major barriers. As we celebrate Children’s Mental Health Week, it’s crucial to extend our advocacy to also champion the rights and inclusion of children with disabilities.

Answer: Signs of suicidal ideation in children can include talking about wanting to die or kill themselves, expressing feelings of hopelessness or being a burden, changes in behavior (like withdrawing from friends, increased irritability, or neglecting personal hygiene), giving away prized possessions, and researching ways to end their life. If you suspect a child is experiencing suicidal thoughts, it’s critical to take them seriously, listen without judgment, stay with them, remove any means of harm, and immediately seek professional help by contacting a crisis hotline, mental health professional, or emergency services.
