I - LEGAL UPDATES
The Supreme Court underscored the importance of timely victim compensation in sexual assault cases involving women and children, mandating Sessions Courts to order such compensation under Section 357-A CrPC. This directive, emphasized by Justices BV Nagarathna and Pankaj Mithal, aims to prevent delays and expedite support, enforced by District or State Legal Services Authorities.
The Supreme Court mandated separate cut-off criteria for recruiting persons with disabilities (PwBD) in District Judiciary to ensure fairness and inclusion. High Courts and State PSCs must set distinct qualifying marks and interview criteria for PwBD candidates, applying horizontal reservation. The order seeks uniform application nationwide for future recruitment processes.
The Bombay High Court upheld the termination of 35 employees for endangering workplace safety through violent strikes and misconduct. The Court ruled employers can take disciplinary action and terminate workers without prior inquiry if justified by subsequent evidence. It confirmed that intimidation and disruption constitute serious misconduct warranting immediate dismissal to ensure safety.
II - Exploring Intersections
During Stress Awareness Week, we delved into stress causes, signs, and management strategies, highlighting that stress stems from personal, societal, and organizational influences. Marginalized groups, such as those with disabilities or from LGBTQIA+ and racial communities, often experience heightened stress due to discrimination and isolation. Creating sustainable work cultures requires mental health awareness and inclusive practices. For tips on managing stress and fostering safe work environments, read more on our LinkedIn page.
