I - LEGAL UPDATES
The Madras High Court directed Tamil Nadu’s government to frame rules under the POSH Act after a medical college failed to address sexual harassment complaints. The court criticized institutional failures and mandated awareness programs, an online dashboard for complaints, gender audits, and funds oversight to improve the implementation of the law.
The Punjab HC ruled against treating a juvenile, charged under the POCSO Act, as an adult due to a delayed psychological assessment. The court found that the required assessment, conducted over three years after the offense, compromised the juvenile’s rights. The juvenile was sentenced to three years, already served in detention.
II - Exploring Intersections
The Supreme Court criticized persistent discrimination against women in governance, highlighting the unfair treatment of a female Sarpanch in Chhattisgarh. Despite her successful efforts, delays and bureaucratic malice led to her unjust removal. The Court reinstated her, awarded compensation, and called for systemic reforms to support women in leadership roles.
