I - LEGAL UPDATES

The Madras High Court ruled that any unwelcome behavior toward women constitutes sexual harassment, regardless of intent. The court upheld the Internal Complaints Committee’s findings against an employee accused of inappropriate conduct under the POSH Act, emphasizing that harassment is defined by the victim’s experience, not the accused’s intent.

The Delhi High Court ruled that a woman’s consent for sex does not authorize sharing private moments on social media. In a case of blackmail and exploitation, the court rejected the accused’s bail application, emphasizing the severity of the allegations, including the non-consensual sharing of intimate videos.

The Delhi High Court ruled that men are entitled to the same protection from cruelty and violence as women. In a case where a wife severely burned her husband, the court rejected her plea for leniency based on gender, emphasizing the seriousness of the crime and the deliberate nature of her actions.

II - Exploring Intersections

Trump’s executive order defining biological sex as binary (male and female) disregards intersex individuals, who do not fit neatly into these categories. The order’s focus on reproductive traits overlooks the complexity of biological sex, which involves various traits like chromosomes and hormones. This exclusion marginalizes intersex people and harms scientific understanding.

President Trump’s “two sex” executive order falsely frames gender as a political ideology. Gender is a natural aspect of human identity, distinct from biological sex. Gender fluidity has existed in various cultures for centuries. This order’s limited definition risks undermining trans rights, legal protections, and healthcare access.

A Class 11 student at Anakkara Government School in Palakkad threatened his principal after his phone was confiscated, sparking concerns about child behavior and media influence. The incident highlights how traditional gender roles and toxic masculinity may contribute to aggression in children, especially boys, who internalize such traits from their environment.

It was International Day of Education on 24th January. We tried to unravel the systemic barriers that arise for marginalized communities while trying to access education. We examined possible hurdles that are faced by girl children, queer or trans children, children with disabilities and children from Dalit, Bahujan and Adivasi communities. 

Recently there was a judgement in Kerala High Court regarding comments on a woman’s body structure. The Court highlighted that such comments can be construed as sexually coloured remarks. It further highlighted the need to address workplace harassment in other forms.
