~ Spotlighting Landmark Judgments since passing of the Law!

I - LEGAL UPDATES

The Delhi High Court upheld JNU’s decision allowing cross-constituency voting in Internal Committee elections for sexual harassment cases. Justice Mini Pushkarna ruled that the move enhanced inclusivity and did not alter election rules. The Court emphasized judicial restraint in electoral matters and dismissed the petition for lack of proven prejudice.
Tamil Nadu’s first transgender Sub-Inspector, Prithika Yashini, challenged CARA’s rejection of her adoption plea, arguing it was discriminatory under the JJ Act and Constitution. The Madras High Court held that existing Adoption Regulations don’t include transgender persons, directed her to seek amendment from the Centre, and closed the petition.
The Kerala High Court, in a suo motu case and a PIL by Bachpan Bachao Andolan, directed time-bound reforms under the Juvenile Justice Act, 2015. Finding systemic lapses in Kerala’s child protection institutions, the Court ordered urgent filling of vacancies, digital monitoring, annual social audits, and strengthened coordination to ensure children’s dignity and rehabilitation.

Did you know Rob Jetten could soon become the Netherlands’ first openly gay Prime Minister? Jetten, 38 years old, leads the centrist Democrats 66 party, is likely to form the government since his far-right opposition seems to be falling behind in the electoral race. After studying public administration, he went into politics to try to make the world better. At 30 he became the youngest member of his party in parliament and later served as the country’s Minister for Climate and Energy. He is engaged to Argentine field‑hockey player Nicolás Keenan. Having openly queer leaders on the global stage is a very important win for inclusion and queer rights, as LGBTQIA+ communities keep facing rising bias and violence worldwide.

Curious Cat: Is addiction a crime or a mental health concern and how to manage it?
 
Answer: Recently, while hearing a case about a former CRPF personnel, accused of killing his wife, the Bombay High Court declared that addiction to alcohol or drugs is a mental illness. This declaration can go a long way to dispel the stigma of moral failure around addiction and help addicts access the help needed.
 
If addiction is seen as a mental health condition rather than a moral failing or a crime, the response should be about care, not only punishment. People need quick access to assessment. They may need detox and medically supervised withdrawal. They should get therapy, such as cognitive behavioural therapy.
 
Some people will benefit from medication‑assisted treatment. Long‑term recovery support is important too — counselling, peer groups, and help with returning to society.
 
We must protect the rights and dignity of people with substance use concerns. We should reduce stigma so more people seek help. And when the criminal justice system is involved, it should be linked to health services.
