I - LEGAL UPDATES
West Bengal’s “Aparajita Woman and Child Bill, 2024” introduces stricter measures for sexual crimes, including time-bound trials, death penalties for severe cases, and life imprisonment without parole for rape and acid attacks. The bill also enhances protection for healthcare workers and children, with a dedicated task force to expedite justice.
The Bombay High Court, responding to the Badlapur sexual assault case, stressed the need for gender respect education. The court appointed a committee led by retired judges to enhance POCSO Act implementation and criticized the SIT for poor investigation. The state was directed to enforce POCSO Act compliance and preventive measures in schools.
The Bombay High Court ruled that attempted suicide under mental stress is not punishable under the Mental Healthcare Act, 2017. A woman police constable charged under IPC Section 309 was granted relief as the court held that the Act presumes mental stress in such cases, precluding criminal prosecution for suicide attempts.
Punjab Police informed the High Court that there are no separate toilets or lockups for transgender individuals in police stations. A petition filed by Sunpreet Singh highlighted the need for such facilities, citing Supreme Court rulings on transgender rights and the risk of abuse in custodial settings.
