~ Spotlighting Landmark Judgments since passing of the Law!

I - LEGAL UPDATES

On October 17, 2024, the Supreme Court of India began hearings on the constitutionality of the marital rape exception in Section 375 of the Indian Penal Code. Petitioners argue this exception violates women’s rights and reduces them to “sexual objects.” The court will examine the implications of potentially criminalizing marital rape. The next hearing is set for October 24, 2024.

The Bombay High Court quashed an FIR against a senior engineer accused of outraging a subordinate’s modesty by touching a lady-shaped paperweight. The court found no substantial evidence supporting the allegations and noted the Vishakha Committee’s earlier dismissal of the complaint, ruling that the case did not meet criteria for prosecution.

The Kerala High Court ruled that a principal and teacher were not guilty of failing to report a crime, as they notified police the day after receiving a complaint. The court found no willful delay in reporting, quashing the proceedings against them under the POCSO Act.
