I - LEGAL UPDATES

The Delhi High Court reaffirmed that the PoSH Act operates alongside existing service law principles and does not curtail an employer’s inherent disciplinary powers. Upholding the suspension of a college principal facing sexual harassment allegations, the Court held that employers may constitute preliminary fact-finding committees and impose interim suspension pending inquiry without encroaching upon the statutory role of the Internal Committee. The ruling clarifies that suspension pending investigation is administrative rather than punitive in nature. 

The Delhi High Court quashed POCSO proceedings arising from a consensual adolescent relationship where the prosecutrix, though a minor at the time of the alleged acts, subsequently married the accused and affirmed that she had suffered no harm. The Court distinguished between statutory victimhood and actual injury, observing that rigid application of the POCSO framework in such circumstances could itself prejudice the welfare of the prosecutrix and her child. The judgment reflects a purposive approach to balancing the protective intent of the statute with lived social realities.

Did you know that the Supreme Court of India recently acknowledged the need for better ways to assess dyslexia in adults? On April 15, the Court disposed of a case after NIMHANS confirmed it’s developing adult-specific tools for dyslexia assessment, with an expected publication in about three years. This case was initiated by a Ph.D. scholar who pointed out that current testing methods are largely based on children, not adults, despite revisions to guidelines. NIMHANS’ research aims to create national norms for assessing adult reading, writing, arithmetic, and cognitive skills, with the Court keeping the option open to revisit the case if progress is insufficient.
 
This is important because dyslexic and neurodivergent adults require assessment systems that understand their unique realities. Access to accurate diagnosis and certification is fundamental for dignity, recognition, and receiving the appropriate support needed to thrive, rather than relying on outdated or ill-fitting tools.

Endometriosis is a condition where uterine-like tissue grows outside the uterus, causing inflammation, pain, and scar tissue. This can significantly impact menstruators through chronic pain, debilitating fatigue, and irregular bleeding, all of which can lead to absenteeism, reduced productivity, and difficulty concentrating. Furthermore, endometriosis can affect reproductive health, potentially causing infertility and the emotional toll of fertility treatments, and may also contribute to mental health challenges like anxiety and depression.
 
Professionally, these symptoms can necessitate workplace accommodations such as flexible schedules or remote work options. For some, the severity of the condition may lead to career limitations or the difficult decision to leave the workforce to manage their health. Understanding these challenges is crucial for employers to support affected employees effectively.
