This month’s POSHequili monthly meeting brought IC members together to explore “Friendships Gone Wrong: POSH Inquiries.” Facilitated by Adv. Bhumika Jain and Sakshi Deshpande, the session examined blurred workplace boundaries, friendship fallout in POSH cases, and the importance of healthy boundaries for fair inquiries and safer, more inclusive workplaces.

I - LEGAL UPDATES

The Andhra Pradesh High Court held that an accused must be afforded an effective hearing under Section 251 of the BNSS before charges are framed, even in POCSO proceedings requiring expeditious trials. Setting aside the Trial Court’s order, the Court ruled that procedural safeguards cannot be sacrificed for speed and clarified that the statutory period for seeking discharge in Special Court prosecutions should be reckoned from the date of supply of police papers.

The Supreme Court held that access to clean and functional washroom facilities is an integral part of the fundamental right to life and dignity under Article 21. Observing that inadequate sanitation disproportionately affects women advocates and hinders their participation in the legal profession, the Court directed all States and Union Territories to assess existing infrastructure, allocate special funds, and construct or upgrade washroom facilities in courts, holding that financial constraints cannot justify non-compliance.
